This document is intended to regulate the Terms of Service for making online reservations with Hello America S.A., whose trade name is HELLO and which manages, administers and is responsible for the program known as "Hello" (hereinafter the "Hello Program"). Hello America, S.A., is a company constituted and existing under the laws of the Republic of Panama, as established in Deed number 12.280 extended in the First Notary of the Circuit of Panama on June 27, 2013, duly registered with Folio No. 155632339, Entry 1, of the Microfilm (Mercantile) Section of the Public Registry on June 29, 2016 (hereinafter "HELLO"). The terms "You" and "User" will hereinafter refer to all individuals who for any reason access www.bookinghello.com (hereinafter referred to as the "Hello Website"), or use the services provided by the Internet portal. The use of these services implies full and unreserved acceptance by the User, as well as the validity of each of the General Conditions of the Program contained in the most recent version of these Conditions. As a customer, You declare to be of legal age, and have sufficient legal capacity to be bound by the Terms of the HELLO Program.
HELLO hereby informs You that the procedures for the provision of services offered are set out in the General Conditions of the Agreement, as well as those that are specifically displayed on the screen during navigation of the Hello Website. As such, You declare to be aware of and accept these procedures to be able to commission the services offered on the Hello Website.
2. Use of HELLO online reservation services.
2.1. Online Reservation Services.
2.1.1. Online Reservation Services: The purpose of the online reservation services is to reserve a service offered by the Hello Program in any of our facilities, or with any of our providers. The use of these services implies full and unreserved acceptance of each and every one of the conditions contained in the most recent version of these terms.
2.1.2. Procedure: the User will previously have accepted the terms and conditions published on the Hello Website for the provision of the services offered by HELLO.
Upon using this service, the User will receive a confirmation email that will include the reference number of his/her reservation. This email serves as proof of the User's reservation, and confirmation of his/her acceptance.
2.1.3. Warranty and General Cancellation Policy:
No refund applies for any request for cancellation, partial use or non-use of the program, as posted on the Hello Website.
Reservations made through the Hello Website will be paid in advance by the User with a credit card, bank transfer or deposit via the online form provided for this purpose. To cancel a reservation, you must contact our Central Reservations Office, telephone number +507-302-3424, Monday to Friday from 9:00am to 5:00pm, and Saturday 9:00am to 12:00pm (GMT-5). Outside these hours, please contact the Provider at your destination, whose contact details appear on the Hello Website.
2.1.4. The prices of the reservation services can be found on the Hello Website, and are subject to change by the Providers.
2.2 Using the Service: The User agrees to use the services in accordance with the law, ethical standards, good practices and public order, and to conform to the stipulations of the General Conditions of the Agreement. As such, use of the services for illegal purposes and/or purposes contrary to the General Conditions of the Agreement, to the detriment of the rights and/or interests of third parties, or which may damage the services and/or their image in any way, is prohibited.
2.3. The Hello Program is subject to change. It may be modified or changed at any time without prior notice, with regard to the services provided or operating conditions, techniques or use of services, to provide greater flexibility and to benefit its Users.
3. Protection of the User's personal data by HELLO.

PRIVACY AND PERSONAL DATA PROTECTION
Hello America S.A. is a legal entity liable under the terms of Act 24 of 2002, as amended under the Protection of Personal Data in the Possession of Private Parties Act (hereinafter referred to as the "Act"), with regard to information requested directly by You through the Internet domain http://www.bookinghello.com/, and the same information collected for the following purposes:
• Handling the operation of transactions for individuals or legal entities that have any kind of relationship with HELLO in their capacity as User of the Hello Program, as described on the Hello Website.
• Treatment of said information to carry out research, statistics, promotions, advertising, notifications and communications of any kind with regard to this Agreement.
HELLO will not transfer the information that it collects. The data requested is relevant because HELLO aims to process the information collected in accordance with the criteria of HELLO to make decisions with regard to the specific relationship it maintains with each of its customers.
The means established for the customer(s) as owners/holders of the information collected to limit the use or disclosure of their data or to exercise their rights to access, rectify or cancel and oppose, will be carried out in writing in accordance with legal requirements, and sent to the following email address: support@bookinghello.com.
The procedure for amending this Privacy Notice consists in obtaining the relevant authorization from HELLO. Similarly, the means by which the content of said modification will be communicated is through publication on the aforementioned Internet domain: http://www.bookinghello.com/.
HELLO has taken measures to protect Users' personal information against damage, loss, alteration, destruction or access, unauthorized use or processing, and constantly updates the necessary administrative, technical and physical security measures.
You agree not to disclose "Confidential Information" (in accordance with the provisions outlined below) to any third party. This provision will be valid even following the termination of the "Intermediation Agreement." "Confidential Information" refers to the contents and terms of the "Intermediation Agreement" and its Addenda, as well as information that is not generally known, which You obtained from HELLO with regard to: (1) rates, benefits, discounts and promotions of the accommodation establishments, service providers or HELLO suppliers, or (2) sales and marketing techniques, business management techniques, lists of CUSTOMER(S) or requests, information regarding service providers or HELLO. Failure to abide by the provisions contained in the General Conditions of the Agreement will result in the immediate termination of the "Intermediation Agreement," with loss of the amounts paid to date to HELLO.
HELLO THIRD-PARTY LINKS.
HELLO is not responsible for links to third parties that lead to other websites. Nor is it responsible for the content or data processing that may occur on the websites of third parties that can be accessed through links or hyperlinks from the Hello Website. 4. Right to Amend the Terms and/or Conditions of the Agreement HELLO reserves the right to unilaterally amend any of the matters contained in the General Conditions of the Agreement, without prior notice and in the manner that it deems appropriate.
5. General Conditions of the Agreement. If one of the provisions of the General Conditions of the Agreement is declared void or unenforceable, the remaining Terms will be maintained as previously agreed. None of the contents of this Agreement affect compulsory provisions regarding consumers. If You are not a consumer, You expressly waive the right of withdrawal.
6. www.bookinghello.com and acceptance of the Terms of Use. The User is aware that use of the Online Reservation Services implies full and unreserved acceptance of each of the clauses included in the Terms of Use of the Hello Website, in the version published by HELLO, at the point at which the User commissions the service. These Terms of Use complement all provisions of the General Conditions of the Agreement, provided that they do not conflict with them. Accordingly, the User must be aware of the importance of consulting the rules of this Website before accessing and/or using these services.
7. Use of Cookies. Access to this Hello Website may involve the use of cookies on the page or pages that are linked or referenced through links. Users who do not wish to receive cookies, or wish to be informed of their use, must configure their browser accordingly.
8. Legislation and Jurisdiction. These Conditions will be governed by the laws of the Republic of Panama. Hello America S.A. and the User expressly forgo any other jurisdiction, and submit themselves to the Courts and Tribunals of Hello America S.A. for any dispute that may arise from the provision of services that are subject to these Conditions.
Hello Program for accommodation, flight and ground transport services
1. General conditions of the Hello Program
The website https://www.bookinghello.com/es/flight-hotel?referrer=hc is owned by Hello América, S.A., whose trade name is HELLO and which manages, administers and is responsible for the program known as “Hello” (hereinafter the “Hello Program”). 2. Purpose of the Hello Program
Hello allows customers to make reservations for lodging establishments, airline services and airport-hotel-airport ground transport on its website https://www.bookinghello.com/es/flight-hotel?referrer=hc (hereinafter referred to as the “Hello Program”).
Through its technological platform, the Hello Program offers a WEB service where customers can contract services offered by accommodation, air transport and ground transport service providers.
The contracting of Hello Program services through the https://www.bookinghello.com/es/flight-hotel?referrer=hc website implies the express acceptance of all the clauses of these Terms and Conditions, together with the particular contractual provisions agreed in the contract for accommodation services, or as indicated in the documentation for their chosen air and land transport services.
3. Hello Program Web Service
As stated in Clause 2 above, the Hello Program is a contract for the provision of WEB services offered by Hello America, S.A., to enable its customers to access a variety of services and which involves the combination of the following services offered on a price basis that combines the totality of all services:
The services covered by the Hello Program are provided by service providers identified on the https://www.bookinghello.com/es/flight-hotel?referrer=hc website. Based on the above, Hello does not provide the accommodation, air and ground services included in the Hello Program; consequently, Hello acts as the provider of the Web Service.
4. Compensation
4.1. Amendments to rates for the Hello Program services.
As a general principle, the rates for the services included in the Hello Program will remain unchanged and will be those established globally on the https://www.bookinghello.com/es/flight-hotel?referrer=hc website. The rates established in the Hello Program will not be reviewed unless the possibility of revision is expressly established.
The review of the rates for the Hello Program will be possible as a direct result of changes to the following:
(a) the price of airport-hotel-airport passenger transport, resulting from increased fuel costs;
(b) the increase in the rates of taxation applicable to accommodation services and airport use; or
(c) the currency exchange rates applicable to the Hello Program in question.
4.2. The price for the Hello Program includes:
1. Indirect taxes on consumption such as value added tax (sales tax), accommodation tax or the name assigned to these taxes in the country in which providers provide the services, when such taxes are applicable.
2. Accommodation services provided at any of the lodging establishments that are included in the Hello Program.
3. All services expressly specified in the contracted Hello Program.
4. Rates for airport use, if applicable.
5. The airport-hotel-airport land transport, when this service is included in the contracted Hello Program.
6. Air transport services.
7. Hotel taxes or tourist taxes are not included in the rate and depend on each hotel according to where it is located. Therefore, the guest will pay said tax separately at the hotel.
Rates are set by the service providers who directly offer accommodation services, air transport services and land transport services. Hello does not set the rates for these services.
4.3. Services not included in the Hello Program:
Any other services not expressly specified in the Hello Program. Also, baggage costs are not included, such that the customer must check with the airline concerned whether it charges for hand luggage in the cabin or putting checked baggage in the hold of the aircraft.
4.4. Payments and refunds.
The contracted Hello Program must be fully paid before the documentation is sent and, in any case, always before the planned departure date. Consequently, payment will have to be made online via the https://www.bookinghello.com/es/flight-hotel?referrer=hc website, with an international credit card of a type authorized on the website itself.
The contracting of a Hello Program means the acceptance of a charge to the credit card used by the customer on the https://www.bookinghello.com/es/flight-hotel?referrer=hc website.
If the charge is rejected for any reason, Hello will cancel the reservation following communication with the customer seeking to correct the problem.
5. Previously contracted Hello Program Modifications and Cancellations.
Dates and bookings made through the Hello Program cannot be changed, and the Hello Program does not permit cancellations.
The Hello Program cancellation policies shall be those established by the lodging establishment, airline and ground transport service provider, included in the Hello Program.
The customer must review the Terms and Conditions and the travel policies of the air service provider, as well as the land transport provider.
6. Modification or cancellation of the Hello Package by Service Providers.
6.1. Prior to the trip.
In the event that, before making the trip, there is a need to significantly modify some essential element of the Hello Program, Hello will immediately inform the customer and will undertake to offer an alternative with the same features as the contracted Hello Program. The customer may choose to cancel the Hello Program without penalty and without the right to a refund for the full price paid, or they may accept a modification to the original Hello Program which specifies the modifications made and their impact on the price.
6.2. During the trip.
In the event that, during the trip, the service providers cannot ensure the provision of the services provided for in the Hello Program, they will adopt the appropriate solutions for the services to be provided. If the customer continues the trip with the solutions offered by Hello, they will be deemed to tacitly accept those proposals.
If the solutions adopted by the service providers are not feasible due to accidental events or force majeure, the service providers must offer the customer an alternative transport solution equivalent to that stipulated in the Hello Program, in order to return to the point of departure or any other place agreed by Hello and the customer, without prejudice to any compensation that may be applicable.
7. Airline responsibilities
A passenger carrying a flight ticket may demand, directly from the airline transporting them, the fulfillment of their obligations in the event of "over booking," serious delays, refusal of boarding, cancellations, loss of baggage, etc., in accordance with the terms of the travel ticket documentation and the terms of applicable laws. Passengers must familiarize themselves with the travel policies of the airline transporting them.
8. General Information about Service Providers
8.1 Airline services.
Passengers must check in at the airport at least three hours in advance of the official departure time indicated on the travel ticket, and, in every case, the specific recommendations indicated in the travel documentation given to the customer shall be strictly followed. With contracted air services, it is recommended that the customer reconfirm 48 hours in advance the flight departure and return times. Other aspects relating to air travel services shall be governed by the provisions of the travel documentation provided by, and the travel policies of, the airline concerned and by the provisions of the airports.
8.2 Category of Lodging Establishments.
The quality and scope of the services provided by the lodging establishments will be determined by the official tourist category, if applicable, assigned by the competent body of the country in which such lodging establishments are located and by the information displayed on the https://www.bookinghello.com/es/flight-hotel?referrer=hc website. Similarly, the scope of the services to be provided by the lodging establishments is set out in the documentation that is issued to the customer with the contracted Hello Program and regulated by the laws applicable in the country in which the lodging establishments are located, and the internal regulations of such lodging establishments.
8.3 Airport-hotel-airport transport service.
For some transfers, it will be necessary for the customer to confirm the pick-up time with the transfer company in advance by calling the number provided in the documentation for that service, which will be issued with the Hello Program. The customer must be familiar with the transport policies of the company providing land transport.
8.4 Luggage.
Customers' baggage and other personal belongings are not included in the Hello Program. Hello is not obliged to respond to any incident or its consequences in connection with baggage and belongings carried by customers and their companions. The service providers of the Hello Program will be responsible in accordance with the legal provisions applicable to them and the terms outlined in the documentation issued to the customer with the Hello Program.
It is recommended that all passengers be present at all loading and handling of their baggage, and that they make a timely claim to air or land carriers and companies or the hotel at the time of any deficiency, damage or disappearance of their baggage.
8.5 Special conditions for children.
Depending on the age of the children, the service provider and the date of travel, it is recommended that the scope of the special conditions existing with each service provider be consulted, regardless of the terms and conditions included in the Hello Program documentation issued to the customer.
All passengers, regardless of whether they are children or under 2 years of age, must be included at the time of booking, indicating the exact age of each passenger.
The age of the child must correspond to the actual age at the trip start date.
Lack of accuracy regarding children's ages may result in extra charges that must be paid directly at the hotel or directly to the airline when checking in to the accommodation service or air transport service.
8.6 Images that appear on the Website and linked pages or hyperlinks
The photographs and maps found on the https://www.bookinghello.com/es/flight-hotel?referrer=hc website, linked pages or hyperlinks are only intended to provide further information to potential customers of the Hello Program.
8.7 International travel
The customer is responsible for ensuring that foreign entry requirements are met, that travel documentation, such as passports, visas or permits (transit, business, tourist or any other) are in order and that any other foreign entry requirements are met. Hello and its Service Providers have no special knowledge regarding foreign entry requirements or travel documentation. We encourage our customers to check travel bans, advice, announcements and warnings issued by the relevant governments before booking trips to international destinations.
Passports, Visas or Permits: customers should check this information with the relevant Embassy or Consulate. Requirements may change and customers must verify the updated information prior to booking and departure. We do not assume any responsibility if the customer is not permitted to board a flight or denied entry to any country as a result of a failure to properly and appropriately carry their passport, visa (permit) or any other travel documentation required by the airline, authority or country, including in countries where they are in transit only. This includes all stopovers that the airplane makes, even if the customer does not leave the airplane or airport.
Health: the recommended travel vaccines may change and the customer should check current recommendations with their doctor before departing. It is the responsibility of the customer to ensure that all health requirements are met when entering transit or final destination countries and that they have had the recommended vaccines, take preventive measures for any disease including COVID-19, taken recommended medications and followed medical advice related to their trip.
Disinsection: Although infrequent, some countries reserve the right to disinfect aircraft in the event of a threat to public health, agriculture or the environment. The World Health Organization and the International Civil Aviation Organization have approved the following procedures for disinsection: (1) spraying the aircraft cabin with an aerosol insecticide while passengers are on board, or (2) treating the interior surfaces of the aircraft with a residual action insecticide when passengers are not on board.
By offering international destinations within the Hello Program, Hello and its Service Providers do not represent or guarantee that travel to those areas is advisable or carries no risk, and we are not responsible for any damage or loss that may arise as a result of a trip to such destinations.
9. Privacy Policy
Hello America S.A. is a legal entity responsible for the information that it requests directly from customers through the https://www.bookinghello.com/es/flight-hotel?referrer=hc website. With the consent of the information holder, the information collected may be used for the following purposes:
• To manage the transactions of individuals or legal entities that have any relationship with Hello as customers of the Hello Program, as described on the https://www.bookinghello.com/es/flight-hotel?referrer=hc website.
• To process such information to carry out research, statistics, promotions, advertising, notices and communications of any kind in relation to these Terms and Conditions of the Hello Program.

Hello America S.A. and the Customer expressly waive any other jurisdiction that may relate to them by virtue of the location of their property, their domiciles or for any other reason, and submit to the Courts and Tribunals of the Republic of Panama in respect of any dispute arising out of the provision of the services subject to these Terms and Conditions.
13. Acceptance of the Terms and Conditions
The Customer is aware that contracting Hello Program services online implies their full and unreserved acceptance of each of the clauses contained in the terms and conditions of use of the website, which are shown here: https://www.bookinghello.com/es/flight-hotel?referrer=hc, in the version published by Hello, at the time the Customer takes out the Hello Program contract.
